Terms of Service

These Terms of Service apply to your use of the Puppy Kind website, store, products, account features, and Pup Club membership. By using the site or placing an order, you agree to these Terms and the policies linked from this page. If you do not agree, please do not use the Services.

1. Using the site

You may use the Services only for lawful, personal, and non-commercial purposes. Do not interfere with the site, attempt to access another person's account, submit false information, introduce harmful code, misuse our content, or use the Services in a way that violates the rights of another person or applicable law.

You must be old enough to enter a contract where you live, or use the Services with the permission and supervision of a parent or legal guardian.

2. Accounts

You are responsible for providing accurate information and keeping your account secure. Tell us through the Contact Us page if you believe an account has been used without authorization. We may suspend or close access when reasonably necessary to protect the site, customers, or our legal rights.

Closing or losing access to a store account does not automatically cancel an active Pup Club membership. Use Manage Account to cancel membership and stop future membership charges.

3. Products, descriptions, and availability

We try to keep product information, images, colors, pricing, and availability accurate. Some details may vary by device or screen. We may correct errors, update products, limit quantities, or discontinue a product. If an error materially affects an order, we may contact you or cancel the affected order and refund any payment collected for it.

4. Orders

Submitting an order is an offer to buy. An order is accepted when we confirm it or begin fulfillment. We may decline or cancel an order for a pricing error, inventory issue, suspected fraud, an address or payment problem, or another legitimate operational reason. If we cancel after collecting payment, we will refund the amount collected for the cancelled order.

5. Pricing and payment

Prices, taxes, shipping charges, and the total due are shown during checkout. Payment is processed by Shopify and the payment providers presented at checkout. You authorize the applicable provider to charge your selected payment method for the amount shown, including applicable taxes, shipping, and any recurring Pup Club charge that you affirmatively authorize.

You must use a payment method you are authorized to use and keep billing information current. If a payment fails, we may pause benefits or access that depend on successful payment until the issue is resolved.

6. Shipping

Shipping availability, charges, and the latest delivery estimate are shown before checkout. Estimates are not guarantees. Orders may arrive in separate packages. After shipment, use the tracking information provided with the order. See our Shipping Policy for more information.

7. Refunds

Our Refund Policy explains the 30-day product guarantee and how to request help. A product refund and Pup Club cancellation are separate actions. Cancelling Pup Club stops future membership charges and benefits; it does not by itself request a product refund.

8. Electronic communications

When you use the Services or contact us, you agree that we may communicate electronically about your orders, account, security, support requests, and membership. Transactional notices are part of providing the Services. Marketing communications include an unsubscribe or preference option where required.

9. User content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to submit it and that it is accurate and lawful. You give Puppy Kind permission to use, reproduce, display, and adapt that content for operating and promoting the Services, subject to applicable law. We may remove content that violates these Terms or is harmful, unlawful, or misleading.

10. Intellectual property

The Puppy Kind name, logos, designs, text, photographs, videos, code, and other content are owned by or licensed to Puppy Kind and are protected by applicable intellectual property laws. You may not copy, modify, sell, distribute, or use them without permission, except for personal use of the Services.

11. Third-party services

The Services may use or link to Shopify and other third-party services. Those services may have separate terms and privacy notices. We are not responsible for a third party's independent service, content, availability, or policies.

12. Disclaimers

To the fullest extent allowed by law, the Services and products are provided without warranties that are not expressly stated in these Terms or a product guarantee. We do not promise that the site will always be uninterrupted, error-free, or secure. Nothing in these Terms limits a right or remedy that cannot lawfully be limited.

13. Liability

To the fullest extent permitted by law, Puppy Kind will not be liable for indirect, incidental, special, consequential, or exemplary damages arising from use of the Services or a product. Our total liability for a claim will not exceed the amount you paid for the product or service giving rise to that claim, except where applicable law requires otherwise.

14. Indemnification

You agree to defend and hold Puppy Kind harmless from claims, losses, liabilities, and costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person's rights, to the extent permitted by law.

15. Termination

You may stop using the Services at any time. We may suspend or terminate access when reasonably necessary for security, fraud prevention, legal compliance, or a material violation of these Terms. Sections that by their nature should continue, including payment obligations, intellectual property, disclaimers, liability, and dispute provisions, will continue after termination.

16. Pup Club membership

16.1 Membership offer

Pup Club is an optional membership. New members receive a 21-day free trial, then membership is $29.99 every 28 days until cancelled. There is no enrolment fee and no minimum term.

16.2 Member benefits

When your membership is active and in good standing, Pup Club includes:

• 50% off products. Your favorites for half the price.
• Free shipping on every order.
• Free replacement filters for your Pet Air Purifier. After three successful, unreversed Pup Club payments, we provide three replacement filters once at no extra charge. This is not a recurring filter plan.
• Gifts and account credit shown in My Account when available under the current offer.
• A membership that helps fund the Puppy Kind Dog Welfare Fund. Your contribution information is shown in My Account when available.

Benefits are subject to product availability, eligibility, and the current offer shown when you join. Benefits cannot be transferred, resold, or combined with an offer that excludes them.

16.3 Joining and consent

You join Pup Club only after affirmatively accepting the membership disclosure shown with the price, free-trial period, recurring billing interval, and cancellation instructions. A checkbox must not be preselected. You authorize the recurring charge after the 21-day free trial unless you cancel earlier.

16.4 Billing

After the 21-day free trial, the authorized payment method is charged $29.99 every 28 days until you cancel. Billing may continue on the same 28-day schedule even if you do not place a product order. Taxes, where applicable, are handled as shown at checkout.

16.5 Cancellation and re-enrollment

You can cancel online at any time from Manage Account. Cancellation stops future Pup Club charges and member benefits at the time shown in the cancellation flow. If you cancel, you must sign up again to become a member. Cancellation does not automatically refund a prior product order or a charge that was already due.

16.6 Failed payments

If a membership payment fails, we may pause or end membership benefits, retry the authorized payment method, or ask you to update billing details. Benefits resume only when the membership is active and in good standing.

16.7 Changes to membership

We may change membership benefits or pricing when allowed by law. We will provide notice of a material change before it takes effect and will explain how to cancel if you do not agree.

17. Promotions

Promotions have the terms shown with the promotion. Unless expressly stated, promotions cannot be combined, exchanged for cash, or applied retroactively. A promotion does not change the recurring Pup Club terms unless its disclosure says so.

18. Governing rules and disputes

Before starting a formal dispute, please use our Contact Us page so we can try to resolve the issue. These Terms are governed by applicable law, except where the law where you live requires a different rule. Nothing in this section removes a consumer right that cannot legally be waived.

19. Changes to these Terms

We may update these Terms when the Services, offer, or legal requirements change. The updated version will be posted on this page with a new date. Your continued use after an update means you accept the updated Terms to the extent permitted by law.
